The important points, in normal language.

1. Parties

This agreement is between you as the seller and the buyer named in your offer.

Two separate buyers buy through CardBuyer.eu: Olivier Schildgen as a private individual in Luxembourg, and InStockNow, Julian's registered German business. Your offer gives the buyer's name and address before you agree. That buyer buys your cards, pays you and issues the purchase record.

In this agreement, “card” means each individual copy.

Clause 13 applies to unsorted bulk.

2. Offer and deadline

The offer states a price per card. Each price is open for 48 hours from when the offer is sent. The exact deadline is shown in the offer.

You decide for each card separately. You can accept the price, make a counter-proposal or decline.

The buyer can accept your counter-proposal or send you a new price instead, which is again open for 48 hours.

If the deadline passes, the price lapses. You can then ask for a new offer.

3. When you are bound

Your card list and the offer do not commit you to anything. You are bound for a card only once you accept its price or the buyer accepts your counter-proposal.

4. Your details

You confirm that the cards belong to you and that you may sell them, and that the name, address and payout details you provide are correct.

For each card you state its condition, language, edition, finish and quantity. Each price assumes that the card matches these details.

5. Shipping

Do not send any cards before a price is agreed and you have received the shipping label from the buyer.

Once you have accepted at least one price and provided your details, the buyer confirms shipping for your order. The buyer sends you a prepaid tracked DHL label and packing instructions. Shipping to the buyer costs you nothing.

For safety, the buyer may split larger or high-value shipments into several parcels. Each parcel then has its own label.

The shipment is insured up to the full value of the cards, with a maximum of €25,000. The insurance only applies if you pack the cards according to the buyer's packing instructions.

6. Inspection

The buyer inspects each card on arrival. If it matches your details, the agreed price stands.

If a card differs from your details, the buyer may send you a new price through your offer link. This inspection price states the reason for the difference and is open for 48 hours.

You can accept the inspection price, make a counter-proposal or decline. Clause 2 applies to your counter-proposal.

7. Returns

If you decline an inspection price or let it expire, the buyer does not buy the card and returns it to you with tracking. The buyer pays the full cost of this return. Nothing is deducted from your payout for it, and you do not have to pay any return costs.

8. Payment

For each card bought, the buyer pays the most recently agreed price.

The buyer pays by bank transfer, PayPal or another method agreed with you, using the payout details you provided.

Payment is made within five business days after inspection, once all purchased cards and all cards to be returned from the shipment have been resolved.

9. Purchase record

For each purchase, the buyer issues a purchase record and sends it to you as a PDF by email. From InStockNow this is a Kaufbeleg (purchase receipt); from Olivier Schildgen it is a private purchase record.

11. Contact and dispute resolution

For questions about your order, write to hello@cardbuyer.eu and include the short order reference.

The buyer is neither willing nor required to take part in dispute resolution proceedings before a consumer arbitration board.

12. Stored version

When you agree, this version is stored with its identifier. The version you agreed to applies to your order.

13. Unsorted bulk

For unsorted bulk, clauses 1 to 4 and 9 to 12 apply with the differences set out in this clause. The rules in this clause replace clauses 5 to 8.

Prices: The buyer pays per 1,000 cards €13 for German, €10 for English and €7 for Japanese and Korean together. Each language is a separate line in the offer with its own price. If you state that 10% or more of the cards are energy cards, the prices are reduced by 10%. The offer shows this reduction.

Lot: Instead of the details in clause 4, you state the number of cards per language and the share of energy cards, with at least 3,000 cards in total. There is no maximum. Holos and reverse holos count. All cards must be Near Mint and undamaged.

Offer: Instead of deciding card by card as in clause 2, you decide on the whole lot. You can accept or decline the offer. There are no counter-proposals for bulk.

Shipping: Send the lot only after you have accepted the offer and the buyer has confirmed shipping. The total weight of the shipment decides. Above 10 kg, the buyer sends you prepaid labels and packing instructions. The insurance through these labels only applies if you pack according to these instructions. At 10 kg or less, you ship at your own cost. A tracked and insured service is recommended. The buyer does not insure this shipment.

Counting: The buyer counts each language line by weight. If the buyer's count is no more than 5% below your number, the buyer pays your number. If it is lower than that, the buyer pays the buyer's count. If it is higher, the buyer pays the higher count. If the paid number ends up below 3,000 cards, the purchase still stands.

Inspection: The buyer checks each language line for damaged cards, cards below Near Mint and energy cards beyond what you stated. If their share is below 5%, there is no deduction. At 5% or more, the price of that line is reduced by 10%. The buyer sends you this new price with the reason through your offer link. It is open for 48 hours, and you can accept or decline it. Before the buyer issues the purchase record, the buyer may correct the result of an inspection. A correction in your favour applies at once. A correction that lowers a price is sent to you as a new price, which you can accept or decline as in this clause.

Returns: If you decline the new price or let it expire, the buyer does not buy the cards of that line and returns them to you with tracking. The buyer pays the full cost of this return. Nothing is deducted from your payout for it.

Payment: For each line bought, the buyer pays the most recently agreed amount. The buyer pays by bank transfer, PayPal or another method agreed with you, using the payout details you provided, within five business days after inspection, once all lines are resolved.
